Kotare residential lease sites The aerial map shows 28 residential sites on KCLT land: leased sites with residents living there; sites available for 34-year or short-term leases directly from KCLT; existing KCLT leases held by KI; and existing KCLT leases held by individual leaseholders. Selling interest has been indicated for the KI and individual leaseholder sites except Site 5. Site 9 is occupied by a caretaker and remains for sale. The map shows residential site categories recorded by KVI. KI holds four sites. Selling interest has been indicated for these and the individual leaseholder sites other than Site 5. Individual listing details are included where supplied and authorised for publication.

For sites offered by Koanga Institute (KI), please enquire directly with KI. For sites available for a new lease from Kotare Community Land Trust (KCLT), please enquire directly with KCLT.

KVI provides village information and, with the leaseholder’s permission, can help interested people make contact. Sales and sublease arrangements are for the leaseholder and interested party to agree, taking account of the applicable lease terms and potential outcomes. KVI does not negotiate or administer individual lease transactions.

Confirm current availability, prices, terms and required approvals with the party making the offer.

Understanding the different arrangements

New lease from KCLT

KCLT grants a residential lease directly to the incoming lessee. The map distinguishes 34-year leases and short-term leases. The new lease specifies the site, term, rent and other costs.

Resale of an existing lease interest

KI or an individual on-sells their interest in an existing KCLT lease. A transfer or assignment passes the lessee’s interest to the buyer, who becomes the lessee under that lease. Land ownership stays with KCLT.

The documents must identify the transfer process and remaining term. Resale of an existing lease does not by itself start a fresh 34-year term.

Sublease through a leaseholder

The current leaseholder retains their KCLT lease and grants a separate sublease to another person. The sublease specifies the agreed area, duration, permitted use and costs, consistently with the underlying KCLT lease.

KCLT remains the lessor under the original lease; the current leaseholder is the sublessor under the separate agreement.

The applicable KCLT lease and the new lease, transfer or sublease documents determine the actual terms and required approvals for the offer.

Questions to settle in writing

The agreement

Which lease and site plan apply? How much time remains? What happens at expiry, and what renewal, termination and dispute provisions apply?

The full cost

What are you paying for the leasehold interest, buildings and other items? What rent, review provisions, rates, levies, insurance and service charges follow?

Buildings and services

Who owns each improvement? What consents exist? Confirm water quality, sanitation, power, access and the condition of any dwelling or structure.

Read about road access and infrastructure.

Living on the site

What uses are permitted? What rules cover guests, businesses, subletting, temporary accommodation and use of shared facilities?

Participation

How do KVI membership, village-class representation and community responsibilities work? Which matters are decided by each organisation?

Leaving or transferring

Who approves a transfer? How is the permitted price calculated? What costs and timeframes apply, and what happens if a buyer cannot be found?

Understanding the residential lease

A residential lease gives you rights to use a defined site; KCLT retains ownership of the land. The existing residential leasehold interests were sold under this form of deed of lease, which provides a 34-year term without a right of extension. Buying an existing lease transfers its remaining term. Surrendering it and obtaining a new lease requires a separate agreement with KCLT.

The template provides for rent reviews and contributions to property expenses. Before committing, confirm the current rent, any outstanding review, rates, other charges and applicable KVI levies. Leaseholders also have responsibilities for residential use, maintenance, insurance, building approvals and compliance with site rules.

This is not a conventional land-banking opportunity. Under the supplied 2015 lease template, the lease component is capped at the price the selling leaseholder paid, adjusted by the Consumer Price Index (CPI) during their ownership. Where there are no qualifying improvements, that CPI-adjusted figure is the maximum resale price.

Any additional amount claimed for buildings or landscape plantings must meet the lease’s valuation and depreciation requirements. The required market valuation must separate the lease value from buildings and improvements and be undertaken by a registered quantity surveyor and/or registered valuer agreed by the parties.

Before agreeing to a price, ask for documentary evidence of the price the current leaseholder paid and a written calculation of the maximum resale price. Check these against the site’s signed lease and any written variations. An advertised asking price does not establish compliance. The maximum is a ceiling, not a guaranteed market value or return.

The template’s resale procedure gives KCLT an opportunity to purchase or nominate a purchaser. Assignment of the whole lease or subletting part of the site requires KCLT’s prior written consent. Unauthorised arrangements can put the lease at risk; the template contains termination provisions whose legal effect should be checked.

KVI acknowledges that lease terms apply to sales and subleasing. KVI’s position is that there is currently no constitutionally compliant Board to process applications, and members cannot reasonably be expected to put their lives, lease sales or income from subletting while awaiting sale on hold indefinitely. In these circumstances, KVI considers it a matter for the leaseholder and interested party to decide how to proceed, taking account of the lease terms and potential outcomes. KVI’s position does not itself provide any consent required under the lease or remove the risks of proceeding without it.

The supplied lease template requires KVI membership and compliance with its rules. Joining KVI requires personal consent. As at 12 October 2026, KVI’s announced position is that no levies apply for the current financial year unless agreed by its membership. Confirm the current position with KVI before committing.

This overview explains the main provisions of that form of lease. Read the particular site’s signed lease, schedules and any written variations before committing.

KCLT’s powers under the lease are expected to be exercised through a Board of Trustees properly appointed and operating in full accordance with the KCLT Constitution, including representation of both the KI and KVI Membership Classes. This overview should be read alongside the current governance concerns outlined on this website.

Useful sections to locate in your own lease
  • Reference schedule and site plan: parties, site, term and permitted use.
  • Clause 5: term and extension provisions.
  • Clause 6: rent, reviews and property expenses.
  • Clause 7: assignment, subletting, consent and sale-price procedure.
  • Termination and dispute provisions, together with any later variations.

Leaving, pricing and recovering capital

Before entering an arrangement, ask what happens when you want to leave. Identify who must approve a transfer, how a buyer is found, which price rules apply and how buildings and other improvements are treated.

Ask for a worked example using the site’s actual documents: the amount paid for the lease interest, any CPI adjustment, the value and depreciation of improvements, deductions and transfer costs. Establish whether you must find an incoming buyer and whether any repayment obligation exists, who would meet it and when.

The 2015 form of deed of lease has a pricing formula in clause 7.1.5. It is a reference for the questions to ask; it does not establish the present sale price, a guaranteed repayment or the terms of a particular offered site.
